Septodont Global Privacy Policy

This policy is issued by Septodont Limited (referred to here as “Septodont”, “we” or “us”), whose principal office is at Units R&S Orchard Business Centre, St Barnabas Close, Allington, Kent ME16 0JZ, United Kingdom.  We are the controller of your personal data as described in this policy.

The protection of your Personal Data is important to Septodont. Septodont has a global privacy programme to help ensure that your Personal Data is handled appropriately and protected in compliance with applicable data protection laws, including when applicable the UK General Data Protection Regulation or UK GDPR.

This policy explains our approach to any Personal Data that we collect from you or that we have obtained or created about you.

Septodont reserves the right to update this policy to comply with changes to applicable law or our privacy practices. We will inform you about any changes updating this privacy on our Website(s).

When you visit our Website(s), we use cookies, “session replay technology” and similar technologies.  Our session replay technology monitors how you interact with our Website(s). This may include, without limitation, which links you click on, information that you type into our online forms, and information about your device or browser.  Please see our cookies policy for more information.

Please note that, if you post any Personal Data on our social networking pages or other interactive areas, you should check the posted rules and privacy notices on those sites. Rules for participation may establish age and other restrictions. Anything you post online is public information. We are not responsible for anything you voluntarily post online. Users should use caution when disclosing Personal Data online.

1. Definitions

“Chatbot” means our artificial intelligence-powered chatbot service through our Website(s).

“Data Protection Officer” means the data protection officer appointed by Septodont.

“GDPR” means the European General Data Protection Regulation 2016/679 dated on April 27, 2016.

“Personal Data” means any information or pieces of information relating to you that could identify you either directly or indirectly.

“Policy” means this privacy policy.

“Process”, “Processing”, “Processes” and/or “Processed” means any operation on Personal Data, such as collection, recording, organisation, storage, alteration, consultation, use, disclosure by transmission, or otherwise making available, restriction, or erasure.

“Septodont Entity(ies)” means Septodont Holding, Septodont Limited and/or any entity directly or indirectly controlled by Septodont Holding.

“UK GDPR” means the GDPR as applied into the laws of the UK.

“User(s)” means any current, past and prospective Septodont customers, individuals reporting medical side effects related to Septodont products, job applicants, service providers, partners, contractors, subcontractors, Website users, visitors and more generally, anyone who is in contact with Septodont.

“Website(s)” means the website www.septodont.com and any other Septodont Entity website or web pages accessible by going to the “Languages” page or link in the homepage of www.septodont.com.

2. What are the principles governing the Processing of Personal Data?

We Process your Personal Data in compliance with the applicable legal requirements and, in particular when applicable, the UK GDPR and GDPR. In particular, we undertake to deploy all efforts to:

  • Process your Personal Data fairly and lawfully;
  • Process your Personal Data for legitimate purposes;
  • Process only Personal Data that is relevant and not excessive in relation to those purposes;
  • Promptly respond to your questions, requests and concerns regarding the Processing of your Personal Data and ensure that your Personal Data is accurate.

3. Which Personal Data do we collect?

Septodont may collect Personal Data such as your name, address, e-mail address, telephone number, other contact details, country of residence, IP address, RPPS number, client code and any other Personal Data you choose to provide to us.

Additionally, Septodont may collect Personal Data about you such as details regarding the products you ordered, details relating to your former orders, data relating to your commercial relationship with Septodont, billing and payment information, information related to your use of our Website (pages you looked at, duration of your visit, etc.), data related to any incident reported about a product (treatments administered, nature of side effects), resume (qualification, previous jobs), etc.

As a User, there are many ways that you might share your Personal Data with us. You may provide your Personal Data to us, either:

  • directly: when you contact us via our Websites or use our Chatbot, when you ask for a quote estimate, when you order our products, subscribe to one of our services, or when you register for a promotion or complete a survey, etc.
  • or indirectly: when we use cookies to understand how you use our Websites, when we receive your Personal Data from business partners or third-party services providers contracted to send out surveys and/or promotional messages, etc.

When you visit one of our Websites, including use of our Chatbot, or engage with us by email or through other electronic methods (such as filling out a contact form on one of our Websites), we may collect information by automated means, using technologies such as cookies. 

If you have applied for a job at Septodont, the Personal Data in your application will be used and retained for recruiting and other human resources purposes. For more information, please contact the Data Protection Officer. 

4. Why do we collect personal data?

Septodont may collect your Personal Data for various purposes, including:

  • To conduct its business in order to: process your orders, provide you the product ordered, manage our relationship with you, manage any request to a product including providing you with more relevant information such as when you use our Chatbot, conclude a specific agreement when you supply us with a product or provide a service. We will process this information to fulfil our obligations in our contract with you or to take steps to enter into a contract with you, and for our legitimate interests to ensure effective administration and management of your relationship with us and to better tailor and personalise your use of our Website(s) and our Chatbot to improve your experience and to ensure our systems, Website(s) and Chatbot are used securely;
  • To optimise access to our e-platforms in order to: identify you and allow you access to Website services, process your identification, optimise online browsing, protect you against fraud or misuse of our Website(s). It is in our legitimate interests to better tailor and personalise your use of our Sites to improve your experience and to ensure our systems and Sites are used securely;
  • To improve our communication and interactions with you in order to: provide you with our newsletters, send you marketing communications, keep an up-to-date opt-out list as applicable if you have asked not to be contacted, identify your preferences, recommend products or services that might be of interest to you, personalise your experience. We will rely on your consent to send you electronic direct marketing. In addition, it is in our legitimate interests to grow our business, to develop our marketing strategy, and to operate suppressors to exclude you from direct marketing if you unsubscribe;
  • To improve and grow our Sites and product line, including to develop new products and understand how our Sites are being used, our customer base, purchasing trends, and the effectiveness of our marketing. It is in our legitimate interests to carry out research and analysis on what services or products our customers want or how they would like us to improve our services and products in order to develop our business and inform our marketing strategy.
  • To allow you to apply for a job in order to: manage recruitment processes, review candidates’ applications, hire candidates. We will process this information to take steps to enter into a contract with you and for our legitimate interests in hiring someone that is suitable for a role. Where you provide any special categories of data (such as your race, gender identity, sexual orientation, or criminal history), we will rely on your consent to process such Personal Data or process it when it is needed for reasons of substantial public interest, such as for equal opportunities monitoring;
  • To comply with applicable law and regulation in order to provide health surveillance report when you report to us medical side effects related to our products. We will process this Personal Data to comply with our legal obligations;
  • To manage your requests, complaints and enquiries, in order to respond to when you ask questions relating to our products, or provide feedback or report an adverse event. We may process this Personal Data where it is in our legitimate interests to understand and respond to inquiries and feedback to improve the quality of the products/services we provide.
  • To allow you to exercise your rights in compliance with this Policy. We will process this Personal Data to comply with our legal obligations.
  • To protect and secure our Sites, assets, network, and business operations, and to detect, investigate, and prevent activities that may violate our policies or be fraudulent or illegal. It is in our legitimate interests to ensure our systems and Sites are used securely.
  • To share data in connection with acquisitions and transfers of our business. It is in our legitimate interests to ensure seamless business operations and continuity and facilitate strategic business decisions.
  • To manage any potential and / or actual litigation or investigations concerning. It is in our legitimate interests to deal with disputes and accidents and take legal or other professional advice. We may also process special categories of Personal Data where it is necessary for the establishment, exercise or defence of legal claims.

5. What are the legal grounds for processing Personal Data?

As mentioned above, Septodont will Process your Personal Data on the basis of at least one of the following legal grounds:

  • Where you have clearly expressed your consent to the Processing of Personal Data (e.g. specific consent given for electronic marketing, an enquiry or application);
  • Where the Personal Data processing is required for the entry into or performance of a contractual relationship between you and Septodont (e.g. to allow performance of an agreement with a supplier or business partner);
  • Where Septodont has to comply with a legal obligation (e.g. comply with legal obligations related to health vigilance provisions);
  • It is necessary in Septodont’s or a third party’s legitimate interest to Process such Personal Data (e.g. to enable us to provide you with the Website or Chatbot, or handle any incident reported about a product).

In addition, we will only process any special categories of personal data (such as your race or ethnicity, sexual orientation, information about your health and information about your criminal convictions and offences) where:

  • you have provided your explicit consent;
  • where it is needed for reasons of substantial public interest, such as for equal opportunities monitoring;
  • we need to do so to carry out our legal obligations;
  • it is necessary for the establishment, exercise or defence of legal claims; and
  • exceptionally, where it is necessary for vital interests relating to you or another person (for example, avoiding serious risk of harm to you or others) and where you are not capable of giving consent.

6.           The Chatbot

The Chatbot is for use by dental professionals only. If you interact with the Chatbot, you are not communicating with a human representative of Septodont; you are communicating with an automated system that generates responses to your inputs based on machine-learning algorithms. We only collect Personal Data that is specifically and voluntarily provided by you in the course of using our Chatbot.  The Chatbot is provided for the limited purposes of (a) providing information and answering questions related to Septodont products; (b) collecting user feedback regarding the use of Septodont products, including feedback related to product quality issues and pharmacovigilance incidents; and (c) otherwise assisting users with their use of the Website(s). We have set out the legal basis we rely on for such purposes in Section 5 above. You are prohibited from entering medical information about identifiable individuals when using our Chatbot.

We may record and retain conversations with the Chatbot for the purpose of addressing your inquiries and otherwise assisting you, improving the operation of the Chatbot, and for other purposes set out in this privacy policy, as long as necessary for the intended purposes and in line with our data retention policy, and we may disclose chatbot conversations to third parties, including our Chatbot vendor.  Please note that our Chatbot is only intended for use by dental professionals, so if you are a patient with questions regarding your treatment or product usage, please discontinue use of the Chatbot and contact your dental professional or physician.

7.           When do we share personal data?

We may share your Personal Data as follows:

  • Within Septodont, and with any Septodont Entity who may only use your Personal Data for the purposes described in this Policy.
  • With our trusted service providers including contractors, subcontractors, agents, advisors, vendors, and suppliers and distributors, who will carry out certain services necessary for the purposes indicated above on our behalf (including marketing-related services, hosting services, database maintenance, operation and maintenance of our Chatbot, etc.).
  • With social media partners.
  • With advertising and analytics partners and networks.

Additionally, Septodont may share your Personal Data with other third parties:

  • To respond to legal proceedings of any nature, court orders or implementing enforcement measures that are required by the competent authorities;
  • To protect the rights, property, or safety of Septodont or other Septodont Entities and to preserve evidence as required or authorized by applicable law;
  • In the event of heath surveillance reporting (pharmacovigilance activity), Septodont may share your Personal Data – as required by applicable regulation – with health professionals, third parties involved in the commercial exploitation of the concerned product, etc.;
  • In connection a change in ownership, such as a merger, business sale or bankruptcy, including to the person who acquires us or our business;
  • For other purposes required by applicable laws or with your prior consent.

Please note that Septodont does not sell your Personal Data to third parties.

8. How do we transfer your Personal Data?

Being a global pharmaceutical company that Processes Personal Data as part of its ordinary course of business, your Personal Data may be transferred from the UK or a country located within the European Economic Area to outside the UK or the European Economic Area. Transfers of Personal Data from one country to another (or one geographic region to another) will be completed in compliance with applicable Personal Data protection laws and with adequate safeguards (eg. standard contractual clauses approved by the UK government or the EU Commission). If you would like to obtain a copy of such safeguards, please contact the Data Protection Officer at dataprotection@septodont.com.

9. How long is your Personal Data retained?

We deploy all efforts to retain your Personal Data no longer than necessary to fulfil the purposes for which it was collected (e.g. the length of your contract with Septodont plus the limitation period for claims). As an exception, we may keep your Personal Data for a longer period of time as required or permitted by law and/or to comply with applicable statute of limitations periods such as tax and accounting requirements and/or to preserve the evidence of performance of an obligation.

10. How is your Personal Data protected?

It is Septodont’s commitment to keep your Personal Data secure. We implement a variety of reasonable organisational and technical measures to ensure the integrity and confidentiality of your Personal Data and to protect your Personal Data against any unauthorised access and modification, disclosure, loss, or destruction.

11. What are your rights regarding your Personal Data?

If you are in [an EU country or] the UK, you can exercise the following rights in respect of your Personal Data, subject to certain exceptions:

  • A right of access: you have the right to obtain confirmation as to whether or not Personal Data concerning you is being Processed, and, where that is the case, to access such Personal Data;
  • A right of rectification: you have the right to request that we rectify inaccurate or incomplete Personal Data that we have about you;
  • A right to deletion: in some cases set forth by applicable data protection law, you have the right to obtain the erasure of your Personal Data;
  • The right to revoke your consent: without affecting the lawfulness of the Processing carried out prior to your revocation, you may revoke your consent to the Processing of your Personal Data when such Processing is based on your consent (unless we are required to Process such Personal Data by law);
  • A right to object to Processing: you have the right to object to Processing of your Personal Data where the Personal Data has been processed based on the legitimate interest of Septodont or a third party, but we may be entitled to continue Processing your Personal Data where we can demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms, or where our continuing to process your Personal Data is relevant to the establishment, exercise or defense of legal claims. You also have the right to object where we are processing your Personal Data for direct marketing purposes and any associated profiling we conduct about you;
  • A right to restrict Processing: in some cases set forth by applicable data protection law, you have the right to request that we do not use your Personal Data (for example, if you believe it to be inaccurate);
  • A right to portability: you have the right to receive your Personal Data which you have provided to Septodont in a structured, commonly used and machine-readable format and to transmit such information to another organisation, where technically feasible:
  • A right to contest automated decisions: in some circumstances you have the right to contest any automated decision made about you where this has a legal or similar significant effect on you, and to ask for it to be reconsidered.  This right does not apply if the decision is based on your consent or is necessary for us to perform or enter into a contract with you; 
  • The right to file a complaint to the supervisory authority: While we suggest that you contact us beforehand, if you wish to exercise this right, you should contact the competent data protection authority. If you live in the UK, you have the right to make a complaint at any time to the Information Commissioner’s Office (ICO), the UK regulator for data protection issues (www.ico.org.uk).
